BOOKING TERMS AND CONDITIONS

THIS DOCUMENT SETS OUT THE TERMS AND CONDITIONS (“TERMS”) ON WHICH ESSOR LIMITED ("US", "WE", "OUR") PROVIDES YOU ("YOU", "YOUR", "USER") WITH ACCESS TO AND USE OF THE WEBSITE LOCATED AT https://www.secretfoodtours.com/ ("WEBSITE") TO BOOK TICKETS TO OUR TOURS. PLEASE READ THESE TERMS CAREFULLY. BY ACCESSING THE WEBSITE OR TICKING THE “I ACCEPT ALL TERMS AND CONDITIONS” BOX, YOU AGREE TO BE BOUND BY THESE TERMS.

 

1. About Essor Limited

1.1 The Website is owned and operated by Essor Limited, trading as Secret Food Tours.

1.2 We can be contacted by email at [email protected] or via the Contact section of the Website.

1.3 By using the Website, you confirm that:

1.3.1 you are legally capable of entering into binding contracts;

1.3.2 you are not prohibited by applicable law from entering into these Terms; and

1.3.3 you are at least 18 years old. Where a booking is made for a person under 18, a parent or legal guardian accepts these Terms on their behalf.

1.4 Unless otherwise stated, all content made available on the Website is owned by or licensed to us.

 

2. About the Website

2.1 The Website provides information about tours (“Tours”) and enables online bookings for tickets (“Tickets”).

2.2 We may update the content of the Website from time to time; however, such content may not always be accurate, complete, or up to date.

 

3. Use and Access to the Website

3.1 You access and use the Website at your own risk. We do not guarantee that the Website will be secure or free from bugs or viruses.

3.2 The Website is made available for personal and private use only. You must not copy, reproduce, modify, distribute, sell, or otherwise exploit any content without our prior written consent.

3.3 Availability of the Website may be affected by events or circumstances beyond our reasonable control.

3.4 We rely on third-party providers, including network providers, data centres, and telecommunications providers, to make the Website available. Whilst we take reasonable steps to provide a reliable service, we do not guarantee that the Website will be uninterrupted, error-free, or available at all times. We shall not be liable for any loss or damage arising from any interruption or unavailability of the Website.

3.5 We reserve the right to suspend the Website, in whole or in part, at any time and for any reason, including for repairs, maintenance, or upgrades. We shall not be liable for any losses arising from such suspension.

 

4. Orders and Payment

4.1 The price of a Ticket includes applicable taxes but excludes any booking or collection fees, which will be displayed before payment.

4.2 Promotional or discount codes may only be applied at the time of booking and cannot be applied retrospectively. Discount codes exclude group and private bookings and are applicable only to individual bookings unless otherwise specified.

4.3 Prices may change at any time, but such changes will not affect confirmed Orders except in the case of an obvious error.

4.4 To book Tickets, you must complete the booking process on the Website and provide the required billing and contact information. You may be directed to a third-party payment processor, in which case their terms and conditions will also apply to your payment. Please review those terms before completing your purchase. 

4.5 An Order constitutes an offer to purchase Tickets. A binding contract is formed only when we issue an Order Confirmation by email.  

4.6 You are responsible for checking the details of your Tickets upon receipt. We are under no obligation to correct errors.

4.7 Tickets are emailed to the address you provide at the time of booking. You are responsible for ensuring that address is accurate. We are not responsible for Tickets sent to an incorrect email address provided by you, nor for Tickets that are subsequently lost, stolen, or destroyed.

 

5. Delivery

5.1 Tickets are supplied electronically by email to the address provided at the time of booking.

5.2 You must present a valid Ticket (printed or on a mobile device) to participate in a Tour.

 

6. Refunds and Exchanges

6.1 Tickets are non-refundable and non-transferable unless expressly stated otherwise in these Terms. The cancellation rights provided under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013 do not apply to the sale of Tickets, as Tours constitute leisure services for which a specific date of performance has been agreed.

6.2 If a Tour is cancelled or rescheduled by us, you will be entitled to a refund or credit at our discretion. Credits will be valid for up to two (2) years from the original booking date. Refund requests must be made within one (1) month of the scheduled Tour date.

6.3 A minimum of two (4) guests is required for a scheduled Tour to proceed. Where this minimum is not met, we reserve the right to cancel the Tour and you will receive a full refund of the face value of the Ticket.

6.4 There will be no refund for lost or stolen Tickets.

6.5 We will use the contact details you provide to notify you of any cancellation or rescheduling. It is your responsibility to ensure those details are accurate. We are not liable for any losses arising from your failure to provide correct contact information.

6.6 Tickets are issued in the name of the lead booker and are valid only for the personal use of you and your party as specified at the time of booking. Tickets may not be resold, transferred, or otherwise assigned to any third party. We reserve the right to cancel any Ticket that has been resold or transferred and to refuse entry to the holder without refund.

 

7. Local Laws and Travel Insurance

7.1 Our Tours operate across multiple jurisdictions. It is your sole responsibility to ensure that you comply with all applicable local laws during a Tour, including laws relating to the legal age for alcohol consumption. We accept no responsibility for any consequences arising from your failure to comply with local laws.

7.2 We strongly recommend that you obtain appropriate travel insurance covering cancellations, delays, illness, accidents, and loss of personal belongings.

 

8. Conduct on a Tour

8.1 Tours may include visits to third-party venues. While we may attempt to accommodate dietary requirements or allergies notified in advance, we do not guarantee the absence of allergens. Consumption of food and drink is undertaken at your own risk.

8.2 By providing information regarding allergies or dietary requirements, you consent to our processing of such information in accordance with our Privacy Notice.

8.3 We reserve the right to refuse admission to, or remove you from, a Tour without refund for late arrival or for behaviour that is unsafe, disruptive, abusive, unlawful, or otherwise inappropriate.

 

9. Participation and Assumption of Risk

9.1 Participation in Tours is voluntary and involves inherent risks, including walking in public spaces, food consumption, weather conditions, and interaction with third parties.

9.2 You agree to take reasonable care for your own safety during the Tour.

9.3 Participation in a Tour will require acceptance of a separate Tour Waiver.  You can review our standard Tour Waiver HERE. Failure to agree may result in refusal to participate without refund.

 

10. Intellectual Property

10.1 All intellectual property rights in the Website, its content, and the Tours are owned by or licensed to us. Nothing in these Terms transfers any intellectual property rights to you.

10.2 During our Tours, our guides may take photographs and/or videos ("Images") of you and any minor children in your care. By participating in a Tour, and as further set out in the Tour Waiver referred to in clause 9.3, you consent to us using Images taken during the Tour on our social media channels and in our marketing materials.

10.3 We will process Images in accordance with our Privacy Notice and in compliance with applicable data protection legislation. If you do not wish to be included in any Images, please contact our customer service team at [email protected] before your Tour. Where Images include minor children, by participating in the Tour you confirm that you have the authority to consent on their behalf.

 

11. User Contributions

11.1 Where the Website permits users to submit content, you grant us a worldwide, non-exclusive, royalty-free, transferable licence to use, reproduce, distribute, prepare derivative works of, display, and perform that user-generated content in connection with the service provided by the website and across different media including to promote our site or the services we provide.

11.2 Any reviews, comments, or feedback you submit via the Website ("Reviews") are non-confidential. You retain ownership of your Reviews but grant us a worldwide, royalty-free, perpetual licence to reproduce, display, and use your Reviews in connection with our services, including for marketing and promotional purposes on our Website, social media channels, and other materials. We will not alter the substance of any Review but reserve the right to edit for length or formatting.

11.3 We also have the right to disclose your identity to anyone who is claiming that any content posted or uploaded by you to our site violates their intellectual property rights or their right to privacy.

11.4 If you wish to contact us in relation to content you have uploaded to our site and that we have taken down, please contact us [email protected].

11.5 Our site may include information and materials uploaded by other users. This information and these materials have not been verified or approved by us. The views expressed by other users on our site do not represent our views or values.

 

12. Third Party Links and Disclaimer

12.1. We use reasonable endeavours to ensure that the information contained on the Website is correct at the time of being published. We reserve the right to make alterations at any time.

12.2. All content published on the Website is provided for information purposes only and does not constitute advice of any nature. Your use of and reliance on Website content is at your own risk.

12.3. Where our Website contains links to other websites or resources provided by third parties, those links are provided for information only. We do not endorse, and accept no responsibility for, the availability, suitability, reliability, or content of any third-party website.

 

13. Data Protection

We will only use your personal data as set out in our Privacy Notice, which is available on the Website. Our Privacy Notice explains the lawful bases on which we process your personal data, your rights in respect of that data, and how to exercise them.

 

14. Limitation of Liability

14.1 We are responsible to you for foreseeable loss or damage caused by our breach of these Terms or failure to exercise reasonable care and skill. Loss or damage is foreseeable if it is obvious that it will happen or if, at the time the Contract was made, both parties knew it might happen.

14.2 We are not responsible for any loss or damage that is not foreseeable.

14.3 Our total liability to you under these Terms shall not exceed the face value of the relevant Ticket, except where liability cannot be limited by law.

 

14. Events Outside Our Control

We are not liable for any failure or delay in performance caused by events beyond our reasonable control, including but not limited to pandemics, public health emergencies, cyber incidents, or changes in law.

 

15. Variation of the Terms

We may amend these Terms from time to time. Updated Terms will be published on the Website with a revised Last Modified date. Amended Terms will apply only to bookings made on or after the date of publication and will not affect any booking confirmed before that date.

 

16. Governing Law

These Terms are governed by English law, and the English courts have exclusive jurisdiction over any dispute arising under or in connection with them.

 

17. General 

17.1 Entire Agreement. These Terms, together with the Tour Waiver referred to in clause 9.3 and our Privacy Notice, constitute the entire agreement between you and us in respect of your use of the Website and the booking of Tours. They supersede all prior agreements, understandings, and arrangements between us, whether oral or in writing. Nothing in this clause limits liability for fraud or fraudulent misrepresentation.

17.2 Waiver. If we do not insist that you comply with any obligation under these Terms, or if we delay in taking steps to enforce our rights, that will not mean that you are released from that obligation or that we have waived our right to enforce it at a later stage.

17.3 Severability. Each clause of these Terms operates independently. If any court or competent authority finds any clause to be unlawful, invalid, or unenforceable, that clause will be treated as removed from these Terms and the remaining clauses will continue in full force and effect.

17.4 Third Party Rights. These Terms are between you and us. No other person shall have any right to enforce them under the Contracts (Rights of Third Parties) Act 1999 or otherwise.
